How Short-Term Disability Claims Get Complicated

Short-term disability coverage is supposed to protect your income when you can't work. In practice, the claims process is often confusing, time-sensitive, and stacked with technical requirements that many people only discover after a denial.

Insurers may argue that the medical evidence is insufficient, claim your condition doesn't meet the policy's definition of disability, or assert that you can still perform certain work duties. These decisions can leave policyholders unsure about what to do next.

Insurance companies frequently request extensive documentation during the claims process. You may be asked to submit detailed medical records, physician statements, diagnostic test results, and documentation of ongoing treatment. Even when you provide what they ask for, insurers sometimes request additional records or clarification, which can delay a decision or become the basis for a denial.

Surveillance, Policy Language & ERISA Rules

Some insurance companies monitor claimants' social media activity or hire private investigators to look for evidence they can use to challenge a disability claim. Even minor activities, taken out of context, can lead to questions about the legitimacy of your claim.

The difference between an "own-occupation" and an "any-occupation" definition of disability, for example, can determine whether benefits are owed at all. Are Short-Term Disability Benefits Taxable?

The tax treatment of short-term disability benefits depends on who pays the premium and how. If you pay your premiums with after-tax dollars, your benefits are generally not taxable income. If your employer pays the premium and doesn't include the cost in your gross income, the benefits you receive may be taxable. In either scenario, short-term disability premiums aren't tax-deductible on your personal return. These are general rules, and your situation may vary.
